Terms of Service

1. Agreement to terms

By registering for or using the LeadEngine platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms form a binding agreement between you (“Tradie” or “you”) and LeadEngine (“we”, “us”, “our”), an Australian business operating at leadengine.com.au.

2. The service

LeadEngine provides a lead generation platform that identifies potential renovation and construction opportunities for trade service professionals. We aggregate publicly available property data — including council planning permits and recently sold property listings — and use artificial intelligence to score and match leads to registered tradies based on their trade category and service area.

Leads are signals, not guaranteed jobs. LeadEngine does not guarantee that any lead will result in a quote request, job, or revenue. We provide information to help you identify potential customers — whether you win the work is entirely dependent on your own efforts.

3. Eligibility

To use LeadEngine, you must:

  • Be at least 18 years of age
  • Be operating a legitimate trade or service business in Australia
  • Hold any licences or registrations required for your trade under applicable state law
  • Provide accurate and complete registration information

4. Subscriptions and payments

LeadEngine operates on a subscription basis. Subscription fees are charged monthly in advance. All prices are in Australian Dollars (AUD) and include GST where applicable.

  • Payments are processed securely by Stripe. We do not store your payment card details.
  • Subscriptions automatically renew each month unless cancelled.
  • You may cancel your subscription at any time through the Settings page. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial months or unused leads.
  • We reserve the right to change pricing with 30 days notice to registered users.

5. Lead claiming and exclusivity

  • When you claim a lead, you receive 48-hour exclusive access to that lead. No other tradie can claim the same lead during this period.
  • The number of leads you can claim per month is limited by your subscription plan.
  • Leads that are not claimed expire after 7 days and are removed from the available list.
  • Claimed leads count toward your monthly allocation regardless of outcome.
  • We reserve the right to adjust lead allocation limits with reasonable notice.

6. Your responsibilities

You agree that you will:

  • Use lead information only for the purpose of contacting potential customers for legitimate trade services
  • Comply with all applicable Australian laws when contacting property owners, including the Spam Act 2003 and the Do Not Call Register Act 2006
  • Not use lead data for any unlawful purpose, including harassment or unsolicited bulk communications
  • Not resell, share, or redistribute lead data to any third party
  • Not attempt to scrape, copy, or extract data from the LeadEngine platform
  • Keep your account credentials confidential and not share them with others
  • Promptly notify us of any unauthorised use of your account

7. Property owner data and privacy

LeadEngine provides property addresses and permit descriptions sourced from public government records and publicly listed property sales. We do not collect, store, or provide homeowner names, phone numbers, or email addresses.

Any contact details you find through your own research and save within the platform are stored privately to your account only. You are solely responsible for ensuring your outreach to property owners complies with Australian privacy law, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

8. Accuracy of lead data

Lead data is sourced from third-party public datasets and scored using AI. While we take reasonable steps to ensure accuracy:

  • We do not guarantee the accuracy, completeness, or timeliness of any lead information
  • AI confidence scores are estimates only and not guarantees of job likelihood
  • Council data may be delayed by several days depending on the data source
  • A property listed as “residential” may not result in work being available

You accept these limitations when using the Service.

9. Limitation of liability

To the maximum extent permitted by Australian law, LeadEngine is not liable for any indirect, incidental, special, or consequential loss arising from your use of the Service, including but not limited to lost revenue, lost profits, or loss of business opportunity.

Our total liability to you for any claim arising from these Terms or the Service is limited to the total fees paid by you in the 3 months preceding the claim.

Nothing in these Terms excludes rights under the Australian Consumer Lawthat cannot be excluded by contract, including consumer guarantees.

10. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or use the Service in a way that harms other users or third parties. In serious cases, termination may occur without prior notice.

On termination, your access to the Service will cease and your data may be deleted in accordance with our data retention policy.

11. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
